These Terms of Service ("Terms") govern your access to and use of the StreamerCheck platform, website, software, and services ("Service") operated by StreamerCheck ("Company", "we", "us", or "our").
By accessing or using the Service, you agree to be bound by these Terms.
1. Service Description
StreamerCheck provides audience authenticity analysis and fraud risk assessment tools for livestreaming and influencer channels.
The Service provides informational and analytical output based on advanced AI systems and expert analyst review.
The Company does not guarantee the absolute accuracy, completeness, or correctness of any analysis. All results are provided for informational and risk assessment purposes only.
2. No Warranty and Disclaimer
The Service is provided on an "AS IS" and "AS AVAILABLE" basis.
To the maximum extent permitted by law, the Company makes no warranties, express or implied, including but not limited to:
- Accuracy
- Reliability
- Fitness for a particular purpose
- Uninterrupted availability
The Company does not guarantee that the Service will be uninterrupted, error-free, or completely secure.
3. Limitation of Liability
To the maximum extent permitted by law, the Company shall not be liable for:
- Any financial losses
- Business losses or lost profits
- Lost contracts
- Reputational damage
- Indirect or consequential damages
arising from use of the Service, inability to use the Service, or reliance on any analysis provided.
The Company's total liability shall not exceed the amount paid by the User to the Company in the previous 30 days.
4. User Responsibility
The User acknowledges that:
- All business decisions made based on the Service are solely the User's responsibility
- The Service is only a decision-support tool
- The Company is not responsible for User business outcomes
5. Intellectual Property Protection
All content, software, algorithms, scoring systems, databases, and technology are the exclusive property of the Company.
Users may NOT: copy, reproduce, reverse engineer, decompile, resell, replicate, or exploit any part of the Service.
Violation may result in legal action.
6. Account and Access
The Company reserves the right to suspend access, terminate accounts, or limit usage at its sole discretion, especially in cases of abuse, suspicious activity, or breach of Terms.
7. Payment and No Refund Policy
All payments are final and non-refundable. The Company does not guarantee specific results or outcomes. Subscription fees are billed in advance. Failure to pay may result in service suspension.
8. Service Availability and Force Majeure
The Company shall not be liable for failure or delay caused by events beyond reasonable control, including but not limited to: illness, incapacity, natural disasters, war, cyber attacks, infrastructure failure, or internet outages.
The Service may be temporarily unavailable. No compensation shall be due.
9. Business Continuity and Right to Modify
The Company reserves the right to modify, suspend, or discontinue the Service at any time without liability.
10. Indemnification
User agrees to indemnify and hold harmless the Company from any claims, damages, losses, or legal costs resulting from misuse of the Service, violation of these Terms, or decisions made using the Service.
11. No Partnership
Use of the Service does not create a partnership, joint venture, or employment relationship between User and Company.
12. Governing Law
These Terms shall be governed by the laws of Brazil. Any disputes shall be resolved in the courts of the applicable jurisdiction.
13. Entire Agreement
These Terms constitute the entire agreement between the User and Company.
14. Disclaimer
StreamerCheck provides probabilistic analysis based on AI and expert review. It does not make definitive fraud accusations. All findings are risk assessments and should be used as part of a broader decision-making process.
